A history making event is in the process of crystallization as the National Assembly of Pakistan has approved the 18th Constitutional Amendment. But, even at this great juncture, despite earlier assurances both by President Asif Ali Zardari and Prime Minister Yousof Raza Gilani to change the barbaric face of this more than 109 year old black draconian law of Frontier Crimes Regulation (FCR), nothing has been done to make it a reality. Once again the tribesmen have been betrayed by the government and Military Establishment of Pakistan. Despite the fact that a committee has already finished its work on the proposed amendments in FCR, they are deliberately not included into the 18th Constitutional Amendment. We tribesmen know well the forces which are hampering and obstructing the promulgation of a just and equitable law in FATA. As the Military is involved in the genocide of Pashtuns in Tribal areas, they are pressuring the government not to introduce the proposed changes in FCR. We strongly condemn this hypocrisy and double standards of the government of Pakistan, completely neglecting the brave tribesmen of FATA, who are still craving for rule of law and supremacy of of Constitution which does not exist at the moment. FATA is still without police, without judiciary, without executive, without political system, without law and without civilization in this 21 ist Century modern day world.
The women were first not represented at the Constitutional Committee, then the name of former military dictator Zia ul Haq’s was removed from the constitution but ironically his black laws which discriminate against women have been kept in-tact, which is really hypocrisy of our politicians (anti-women legislations such as Hudood Ordinance, Law of Evidence, Qisas and Diyat are still there). The law of blasphemy is still hanging like a sword on the heads of innocent religious minorities. So, this constitutional package has betrayed the already persecuted and traumatized sections of the society like religious minorities, tribesmen and women.
