TORTURE OF ABDUL QAYYUM Utmankhel by Military Secret Services & Police in Pakistan

II. Circumstances surrounding torture

A. Date and place of arrest and subsequent torture:

 17-05-2019 At Loralai district of Balochistan, Pakistan

B. Identity of force(s) carrying out the initial detention and/or torture (police, intelligence services, armed forces, paramilitary, prison officials, other)

 In the first case the Military Intelligence services  of Pakistan either ISI OR Military Intelligence (MI) arrested him on 17-05-1019 at Loralai took him BLIND FOLDED to a headquarter of  the agency, he resisted his abduction and hit by the security personnel on his head with pistol and then blind-folded him with a cap. He was semi- unconscious and  on arrival at the center he was tortured again with wooden rod and whipped on all body.

Second time, he was arrested by Police in Hayatabad phase 3 area Police station, peshawar Khyber Pakhtunkhwa on June 4, 2019 at 18:00 h, tortured him took him to the police station and again tortured him.

C. Were any person, such as a lawyer, relatives or friends, permitted to see the victim during detention? If so, how long after the arrest? NO.

D. Describe the methods of torture used

First hit with a pistol/Revolver on head Beaten with WOODEN ROD and WHIPPED on all body parts.

E. What injuries were sustained as a result of the torture?

1.  Head injury
2. Injury scars on the right and left feet below knee
3. Injury scars were there on the right and left hands
4. Injury scars were there on the back on the right and left side.

F. What was believed to be the purpose of the torture?

Abdul Qayum was tortured because he was an eye-witness of the torture and subsequent killing of Arman Loni (another PTM leader) by a police officer Atta ur Rehman Tarin in Loralai, Balochistan. The Military Intelligence services of Pakistan are systematically harassing, abducting, torturing and even killing all those 4 persons including him who have registered First Information Report against the police officer Atta ur Rehman Tarin; to abandon the case against the police officer. Mr. Utmankhel was abducted in broad day light by Military Intelligence of Pakistan on May 17, 2019. He was taken to a nearby internment centre where brutally tortured and later thrown away in a street with the threats that next time, he will be killed.

On February 2, 2019 while Arman Loni was protesting against the Taliban suicide attack on Police personnel in the Loralai District of Balochistan, was arrested by an Assistant Superintendent of Police (ASP) Atta ur Rehman. The said ASP ordered his subordinates to kill him. Later, he (ASP) himself thrashed Arman on his head and neck with his rifle, which resulted in severe injuries and he fell unconscious and later killed.

Furthermore, the same ASP, stopped the friends including Abdul Qayyum to take Arman Loni to the hospital by blocking their car with his official Jeep. So, there was clear intention and determination on the part of Security personnel to kill him. Later, he succumbed to the injuries and died before his arrival at the hospital.So, the purpose of the torture was to stop him from persuing the case of Arman Loni in the courts.

NOTE: The victim is an eye witness to summary execution and torture by security forces of Pakistan. So, his life is in danger. Urgent action is needed to protect his life. Keeping in mind the bad track-record of Pakistani law enforcing agencies particularly ISI & MI which are involved in abductions, torture and killing of innocent civilians, we fear for his.

G. Was the victim examined by a doctor at any point during or after his/her ordeal? If so, when? Was the examination performed by a prison or government doctor?

Yes, he was examined by a doctor and after his arrest and torture. He was admitted at the hospital on 18-05-2019  and was discharged on 21-05-2019.

H. Was appropriate treatment received for injuries sustained as a result of the torture?

The victim was not treated by the government rather he was thrown out on a road. He personally went to a private doctor and was treated.

I. Was the medical examination performed in a manner which would enable the doctor to detect evidence of injuries sustained as a result of the torture? Were any medical reports or certificates issued? If so, what did the reports reveal?

He was examined and the reports are attached and even the photos are attached when tortured.

J. If the victim died in custody, was an autopsy or forensic examination performed and which were the results? The victim is alive and the results of medical tests are attached.

III. Remedial action

Were any domestic remedies pursued by the victim or his/her family or representatives (complaints with the forces responsible, the judiciary, political organs, etc.)? If so, what was the result? No. Because, the police is against him and his reports are not registered.
